Accidents

DUI – Accident

Only a small percentage of DUI cases in Ventura County involve an accident of any kind. Even a smaller percentage involve injury accidents. However, much of the strict punishment for a DUI in Ventura County comes as a result of that very small percentage of DUI cases with a serious injury or fatality. On a DUI with an accident, no matter how small, the Ventura County District Attorney will be looking for mandatory jail time and harsher terms of probation.

DUI = Assumption of Fault

Regardless as to the cause, it will be assumed by the Ventura County District Attorney that you are at fault for the accident if you are arrested for DUI. If your case involves an accident, it is advised that you retain a Ventura DUI attorney as soon as possible. Call me today at (805)564-4384.

Fender Bender

An accident in a Ventura DUI case includes any case in which the person arrested for DUI hit something with their car, no matter how small the damage. A fender bender, such as backing into a parked car in a parking lot, is prosecuted as an accident DUI, and mandatory jail time will be sought.

Single Car Accidents

In Ventura County DUI cases, even a single car accident will be prosecuted as an accident DUI. A single car accident is one of the DUI Driving Patterns focused on by the Ventura County District Attorney, and mandatory jail time will be sought. Even in cases where the only damage is to your own car.

Restitution – Term of Probation

Restitution is the amount of money owed for the damage the accident caused. Your insurance policy may cover a portion or all of the amount. On a Ventura DUI with an accident, the payment of restitution will be sought as an additional term of probation. It is usually beneficial to show proof that restitution has been paid in full as part of the case's resolution.
