In most Ventura DUI cases, the officer will attempt to get you to submit to a breath test even before you have been arrested. If you are over 21 and not on probation for a DUI, any breath test that is prior to a DUI arrest is 100% voluntary.

Chemical Test – Evidential Breath or Blood Test

After a DUI arrest, one of the conditions of having a driver's license in California is that you agree to submit to a chemical test of your breath or blood. There are very strict procedures that must be followed with respect to these breath and blood tests, which must be performed by individuals with the appropriate qualifications.
