DMV Hearing
Only 10 Days to Request
The DMV hearing has to be requested within 10 days of being arrested for a DUI in Ventura. If the hearing is not requested, your license will be suspended when the pink temporary driver's license expires after 30 days. The soonest you will be eligible to apply for a restricted license to drive to work is 30 days later.
Independent of Court Date
The DMV hearing is not connected with or related to your court date. This hearing strictly concerns your driver's license, and whether or not DMV suspends it independently from the resolution of your court case. It can sometimes prove beneficial to coordinate the outcome of the DMV hearing with that of the court case.
Second Temporary Driver's License
Provided that the hearing is requested within 10 days, the DMV will send a fully valid temporary driver's license to you. This white paper license replaces your pink 30 day license, and it stays valid pending the outcome of the DMV hearing.
Police Reports Before Court Date
In most Ventura DUI cases, requesting the hearing within 10 days results in seeing the police reports well in advance of the court date. This proves advantageous in every Ventura DUI case, regardless of circumstance. Additionally, it provides the opportunity to subpoena any evidence that might be outstanding, including the calibration logs for the breath machine and any audio or video recordings.
